Probate

We can help you through this difficult process by obtaining the Grant of Probate on your behalf. We will also undertake the collecting and distributing of assets if required.

How much does this service cost?

TOTAL: fixed fee of 1% of the gross value of the estate + VAT @ 20%.

This includes: obtaining the grant and collecting assets.

Breakdown of costs:

Legal fees £1% with a minimum legal fee of £750

VAT on legal fees 20%

Disbursements

  • Probate court fee of £300.

  • Bankruptcy-only Land Charges Department searches (£2 per beneficiary).

  • £87.30 + VAT @20% Post in The London Gazette – Protects against unexpected claims from unknown creditors.

Disbursements are costs related to your matter that are payable to third parties, such as court fees. We handle the payment of the disbursements on your behalf to ensure a smoother process.

As part of our fixed fee we will:

  • Provide you with a dedicated and experienced probate solicitor to work on your matter

  • Identify the legally appointed executors or administrators and beneficiaries

  • Accurately identify the type of Probate application you will require

  • Obtain the relevant documents required to make the application

  • Complete the Probate Application and the relevant HMRC forms

  • Draft a legal oath for you to swear

  • Make the application to the Probate Court on your behalf

  • Obtain the Probate and securely send two copies to you

On average, estates that fall within this range are dealt with within 25-30 weeks. Typically, obtaining the grant of probate takes 25-30 weeks. This is dependent depending on the complexity of the estate and the response from the relevant authorities.

Not included in our fee is the cost of the court fee, Office copies fee and postage. There is also a separate fee for if you require us to administer the estate in accordance with Probate Law.

Lasting Power of Attorney

If you should ever need help in managing your affairs whilst you are still alive, lasting powers of attorney will enable you to choose who you want to help you. We can advise you of the different types of powers of attorney and can prepare and deal with the registration of them for you to ensure that they are done correctly and are ready to use for your family as and when needed.
